Drunk driver responsible for death of unborn child in vehicle crash

Kenner-A Kenner man with a long history of arrests for intoxicated related offenses was arrested while operating a vehicle while intoxicated and Third degree feticide, after he failed to yield an intersection at Alabama Street and Vintage Drive (Kenner) and was responsible for a vehicle crash, resulting in the death of an unborn child. 

 On Sunday, March 3, 2013, Bernal Lino Aguilar, 48, who provided the home address of 4111 Delaware Avenue, # 32, Kenner, was arrested and charged with the crimes of Operating a motor vehicle while intoxicated (.156g% BAC), Operating a vehicle while under suspension for DWI, Third degree feticide, Vehicle negligent injuring, First degree vehicle negligent injuring, and Reckless operation of a motor vehicle. 

 At approximately 06:46 p.m., Sunday, March 3, 2013, the Kenner Police Department responded to a vehicle crash at Alabama Avenue and Vintage Drive.  It was there officers learned that a Chevrolet Silverado pick up, driven by Bernal Lino Aguilar, was observed by a witness traveling the wrong way in the 3800 block of Chateau Boulevard (Kenner).  The witness followed Aguilar from Chateau Boulevard to Alabama Avenue and Vintage Drive.  The witness observed Aguilar to stop for a stop sign at Alabama Avenue, south of Vintage Drive.  Aguilar then proceeded forward into the direct path of a Mitsubishi Galant traveling west on Vintage Drive.  Aguilarís vehicle (the at fault vehicle) was struck on the passenger side by the front part of the Mitsubishi Galant. 

 Two occupants of the Mitsubishi a female driver and female passenger (18 years old) who was pregnant were injured in the crash.  The female driver received lacerations to her right hand and knee.  The female passenger who was seven months pregnant complained of abdominal pain.  The passenger was transported by ambulance to Ochsner Kenner, where it was later learned the passenger sustained a lacerated uterus and the un-born child perished as a result of the injury. The female passenger underwent surgery and remains in ICU in critical condition.   

 Aguilar was arrested on the above charges. 

 A driverís license query revealed that Aguilar had a Louisiana driverís license that is suspended for 730 days (December 5, 2011 to December 4, 2013) as a result of a DWI arrest.  As the result of the death of an unborn child, the Kenner Police Department obtained a blood sample from Aguilar that will be submitted to the Louisiana State Police Crime Laboratory for analysis.  In addition, Aguilar participated in a breathe test for intoxication, which revealed a .156g% blood alcohol concentration. 

 A review of the Jefferson Parish Court House records revealed that on February 19, 2003, Aguilar pleaded guilty to DWI-3rd Offense.  As the result of the guilty plea, Aguilar was sentenced to 2 years hard labor, suspending all but 30 days to be served in the Jefferson Parish Correctional Center, and placed on active probation for 2 years. 

 In addition, Aguilar has pending charges in 24th Judicial Court for 4th Offense or more DWI and possession of a legendry drug without prescription (Prazosin Hydro-Chloride) from a December 5, 2011, arrest for which he was charged with operating a vehicle while intoxicated, reckless operation of a motor vehicle, open alcoholic container in a motor vehicle, and possession of a legendry drug without RX. 

 As stated in this press release Aguilar has a long history of arrest for alcohol related offenses:

          Disturbing the peace (drunk)

          December 21, 2000: (Jefferson Parish)

          Operating a motor vehicle while intoxicated

          Simple obstruction of a highway

          No seat belt

          March 8, 2002: (Jefferson Parish)

          Operating a motor vehicle while intoxicated  (pled guilty)   

          June 16, 2002: (Orleans Parish)

         Operating a motor vehicle while intoxicated

          Reckless operation of a motor vehicle

 At the time of this press release, Aguilar remains in custody, no bond has been set.
